What is Family Law Mediation?
Alternative Dispute Resolution is a way of attempting to resolve disputes without having to litigate a matter through the Court process. Mediation is one form of Alternative Dispute Resolution in which the mediator is an independent facilitator.
The family law process of mediation is known as Family Dispute Resolution (commonly referred to as ‘FDR’). A Family Dispute Resolution Practitioner (FDRP) is the person who undertakes Family Dispute Resolution.
Unless exempt, the Family Law Act 1975 requires parties to first attempt to resolve their dispute through Family Dispute Resolution, prior to commencing proceedings in Court seeking a parenting Order.
